DECISION & ORDER ON MOTION

2017-1985 S CR
The People of the State of New York, Respondent, v Vincent Dandraia, Appellant.

Motion by appellant on an appeal from a judgment of conviction of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, rendered September 13, 2017, to restore the appeal to the general calendar. By decision and order on motion of this court dated January 25, 2019, the appeal was stricken from this court's appeals calendar and general calendar, as settled transcripts of pretrial and trial appearances were not included in the record on appeal. The missing transcripts have now been made part of the record on appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied as unnecessary, as the appeal was automatically restored to the general calendar and the appeals calendar upon the receipt of the record on appeal.
