The People of the State of New York, Respondent, v Michael J. Gesmundo, Appellant.

Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the Justice Court of the Town of Wallkill, Orange County, rendered February 8, 2019, on an abridged record dispensing with the trial transcripts.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED, on the court's own motion, that appellant's time to perfect the appeal is enlarged to October 4, 2019; and it is further,

ORDERED that in the event appeal is not perfected on or before October 4, 2019, the court, on its own motion, may dismiss the appeal, or respondent may move to dismiss the appeal, on three days' notice, and may serve such application in person.
