Motion by appellant for a stay pending the determination of an appeal from an order of the Civil Court of the City of New York, Kings County, entered July 9, 2019.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied with leave to appellant to renew, in the Civil Court, the motion which gave rise to the order appealed from, based on the newly discovered evidence presented.
As this court does not consider evidence that is dehors the record, appellant's newly discovered evidence must first be reviewed by the Civil Court.
