It is Ordered that the motion of the petitioner-respondent is granted unless, the respondent-appellant complies with the following conditions. Respondent-appellant shall: (1) perfect his appeal by the December 2019 term the filing deadline for which is October 7, 2019. Respondent's briefs are to be filed no later than October 30, 2019; reply briefs, if any, are to be filed no later than November 8, 2019; (2) pay petitioner-respondent outstanding use and occupancy from May 2019 through August 2019 in the amount reserved in the most recent lease agreement on or before September 9, 2019, without prejudice; (3) pay petitioner-respondent accruing use and occupancy in the amount reserved in the most recent lease agreement on or before each rental date, without prejudice. In the event of respondent-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move, on five days notice, for an order vacating the stay and dismissing the appeal.
