On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated August 9, 2019, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by the attorney for the child to dismiss an appeal from an order of the Family Court, Suffolk County, dated June 7, 2018, on the ground that it has been rendered academic or, in the alternative, to extend the time to serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to extend the attorney for the child's time to serve and filed a brief is granted, the attorney for the child's time to serve and file a brief is extended until September 9, 2019, and the brief shall be served and filed on or before that date; and it is further,
ORDERED that the motion is otherwise denied; and it is further,
ORDERED that pursuant to § 670.3(b) of the rules of this Court (22 NYCRR 670.3[b]), the respondent's time to serve and file a brief is extended until September 9, 2019, and the respondent's brief shall be served and filed on or before that date.
