DECISION & ORDER ON MOTION

Appeal by Randy Zelin from an order of the Supreme Court, Nassau County, dated May 10, 2019. By order to show cause dated July 29, 2019, the appellant was directed to show cause before this Court why the appeal from so much of the order as denied the appellant's motion in the underlying action should or should not be dismissed on the ground that this portion of the appeal is academic because the subject child is now 18 years old.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal from so much of the order as denied the appellant's motion in the underlying action is granted, and that portion of the appeal is dismissed (see De Oliveira v De Oliveira, 151 AD3d 1062).
