DECISION & ORDER ON MOTION

SP Property 232 Court, LLC, Respondent, v Ideal Properties Group, LLC, Appellant.

On the court's own motion, it is

ORDERED that this appeal from a final judgment of the Civil Court of the City of New York, Kings County, entered June 11, 2018, is stricken from the general calendar and the appeals calendar on the ground that the appeal has not been properly perfected in that the transcripts for the first part of the trial have not been included in the record; and it is further,

ORDERED that the stay granted by decision and order on motion of this court dated October 19, 2018 and extended by decision and order on motion of this court dated March 1, 2019 is continued on the condition that the appeal be perfected by November 1, 2019, and on the further condition that appellant continue to comply with the other terms of this court's decision and order on motion dated October 19, 2018; and it is further,

ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, without further notice, or respondent may move to vacate the stay, on three days' notice, and may serve application in person.
