The People of the State of New York, Plaintiff, v Richard Brummel, Defendant.

Motion by defendant to recuse the Appellate Term Justices sitting in the Tenth Judicial District from hearing his pending application, pursuant to CPL 450.15 and 460.15, for a certificate granting leave to appeal to the this court from an order of the District Court of Nassau County, First District, entered May 3, 2019, and, among other things, to remove his pending motion to reargue the order entered May 3, 2019 from the District Court of Nassau County.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
