2019-09573, 2019-09574 In the Matter of Muhammad Z. Khalid, appellant, v Warda Shafiq, respondent. (Docket Nos. V-6195-19, V-6196-19)
| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of two orders of the Family Court, Kings County, both dated August 6, 2019, pending hearing and determination of appeals therefrom, and to waive the motion filing fee.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,
ORDERED that on the Court's own motion, the appeals are dismissed, without costs or disbursements, as no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 6, part 3 (see Family Ct Act § 1112), and leave to appeal has not been granted; and it is further,
ORDERED that the motion is otherwise denied as academic.
DILLON, J.P., MALTESE, DUFFY and BARROS, JJ., concur.
