2019-00192, 2019-01100 In the Matter of Alijca Donkor, respondent, v Maxwell Donkor, appellant. (Docket Nos. V-1113/1115-14/18A, V-1113/1115-14/16A, V-1113/1115-14/18D)
| DECISION & ORDER ON MOTION |
Motion by the appellant pro se to stay enforcement of stated portions of an order of the Family Court, Orange County, dated November 27, 2018, and an amended order of the same Court dated January 7, 2019, pending hearing and determination of appeals from the orders, to enlarge the record to include certain material, for poor person relief, for the assignment of counsel, and to extend the time to perfect the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the record to include the material marked for identification at the hearing of the above-entitled matter as Exhibits A and II is denied as unnecessary, as that material is properly part of the record on the issue of whether the Family Court should have entered that material into evidence at the hearing; and it is further,
ORDERED that the branches of the motion which are for poor person relief and for the assignment of counsel are denied, with leave to renew, on or before November 4, 2019, upon proper papers, including the appellant's affidavit setting forth the appellant's full financial situation including all assets, both real and personal, as well as any and all sources of income and expenses, including the amount and source of funds for the transcripts of the proceedings which the appellant has obtained, the value of the marital residence, and equity in the marital residence; and it is further,
ORDERED that the appellant's time to perfect the appeals is extended until November 4, 2019; and it is further,
ORDERED that the motion is otherwise denied.
MASTRO, J.P., CHAMBERS, LEVENTHAL and CHRISTOPHER, JJ., concur.
