On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated September 25, 2019, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Nassau County, entered March 5, 2019, on the ground that no appeal lies from an order denying leave to reargue. Application by the appellants to extend the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,
ORDERED that the application to extend the time to perfect the appeal is granted, and the appellant's time to perfect the appeal is extended until November 11, 2019.
