DECISION & ORDER ON MOTION

Motion by the appellant for leave to prosecute an appeal from a judgment of the Supreme Court, Queens County, rendered August 7, 2019, following a trial, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied as unnecessary in light of the decision and order on motion of this Court dated September 18, 2019, which granted poor person relief and assigned counsel to the appellant pursuant to CPL 380.55.
