It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that petitioner-respondent's motion is denied and the cross-motion by respondent-appellant is granted to the extent of staying enforcement of the final judgment and warrant of eviction upon the condition that (1) respondent-appellant perfects the appeal by the March 2020 Term, the filing deadline for which is January 8, 2020, and (2) continue to pay use and occupancy as directed in the August 26, 2019 order of this court. Respondent-appellant's request to stay further proceedings in Civil Court is denied.
