DECISION & ORDER ON MOTION

Kitty Holding Corp., Respondent, v Brian Corriette, etc., Appellant.

Motion by appellant on an appeal from a final judgment of the District Court of Nassau County, First District, entered March 7, 2019, and an order of that court entered March 25, 2019, for leave to reargue his opposition to respondent's prior motion to vacate a stay granted by decision and order on motion of this court dated April 25, 2019, which prior motion was determined by decision and order on motion dated July 19, 2019. Separate motion by appellant for an enlargement of time to perfect the appeal.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that appellant's motions are consolidated for purposes of disposition; and it is further,

ORDERED that appellant's motion for leave to reargue is denied; and it is further,

ORDERED that appellant's motion for an enlargement of time to perfect the appeal is denied as unnecessary, as appellant has 90 days from September 6, 2019, the date the record was received by this court, to perfect the appeal (see Rules of the App Term, 9th & 10th Jud Dists [22 NYCRR] § 732.8 [a]).
