DECISION & ORDER ON MOTION

Motion by Spolzino, Smith, Buss & Jacobs, LLP, for leave to withdraw as counsel for City of Mount Vernon and Mount Vernon Industrial Development Agency on an appeal from a judgment of the Supreme Court, Westchester County, dated April 9, 2018.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and Spolzino, Smith, Buss & Jacobs, LLP, shall immediately serve the Corporation Counsel of the City of Mount Vernon with a copy of this decision and order on motion, pursuant to CPLR 2103(b)(1) or (3).
