Appeal from an order of the Supreme Court, Kings County, dated April 18, 2018. By order to show cause dated September 20, 2019, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal for failure to comply with a decision and order on motion of this Court dated April 3, 2019. Application to withdraw the appeal.
Now, upon the order to show cause and the papers filed in response thereto, and upon the stipulation of the parties dated October 2, 2019, it is
ORDERED that the appeal is deemed withdrawn, without costs or disbursements; and it is further,
ORDERED that the motion to dismiss the appeal is denied as academic.
