DECISION & ORDER ON MOTION

Motion by the Grievance Committee for the Tenth Judicial District for an order pursuant to Judiciary Law § 90(6) permitting service of a notice of verified petition and verified petition, both dated May 16, 2019, to be made upon the attorneys and counselors-at-law listed herein, who have failed to maintain their attorney registration in violation of Judiciary Law § 468-a, by means of publication of the notice of verified petition, verified petition, and the names and last registered or known business addresses of the subject attorneys and counselors-at-law, or, in the absence of a business address, the last known home address of those attorneys and counselors-at-law, in the New York Law Journal on five successive dates.

Upon the affirmation of Michele Filosa, Staff Counsel to Catherine A. Sheridan, Chief Counsel for the Grievance Committee for the Tenth Judicial District, dated May 16, 2019, and the affidavit of Samuel Younger, Chief Management Analyst for the Office of Court Administration, dated May 9, 2019, and upon the verified petition dated May 16, 2019, and the exhibit annexed thereto, and upon finding that the attorneys and counselors-at-law on the annexed schedule cannot with due diligence be found within New York State to effectuate personal service:

ORDERED that the motion is granted; and it is further,

ORDERED that the attorneys and counselors-at-law whose names are listed herein above may be served with the notice of verified petition and verified petition, as well as a copy of this decision and order on motion, by publication of the names and last registered or known business addresses of those attorneys and counselors-at-law, or, in the absence of a business address, the last known home address of those attorneys and counselors-at-law, in the New York Law Journal on five consecutive business days beginning one week after the date of this decision and order on motion; and it is further,

ORDERED that, in accordance with the aforesaid notice of verified petition and verified petition, upon the failure of any attorney or counselor-at-law listed in the published notice to submit proof establishing his or her full compliance with all registration requirements under Judiciary Law § 468-a, together with an explanation of his or her failure to respond to the previous notifications of default, within 30 days of the last day of publication of the notice, the Court will, upon application of the Grievance Committee for the Tenth Judicial District made without further notice, issue an order immediately suspending such attorney from the practice of law in the State of New York.
