et al., defendant.

(Index No. 8543/16)

ORDER TO SHOW CAUSE

Appeal from a judgment of the Supreme Court, Nassau County, entered January 7, 2019. By decision and order on motion of this Court dated June 18, 2019, as amended October 2, 2019, the notice of appeal from two orders of the same court was deemed to be a premature notice of appeal from the judgment to the extent that the judgment brings up for review the orders and the appellant was directed to serve and file a supplemental record containing the judgment on or before July 10, 2019. The appellant has failed to file the supplemental record containing the judgment.

Now, on the Court's own motion, it is

ORDERED that the parties to the appeal are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal for failure to comply with the decision and order on motion of this Court dated June 18, 2019, by filing an affirmation or an affidavit on that issue in the office of the Clerk of this Court on or before December 5, 2019, or, if the appellant be so advised, by making a motion, on or before December 5, 2019, to extend the time to comply with the decision and order on motion of this Court dated June 18, 2019; and it is further,

ORDERED that the Clerk of this Court, or her designee, is directed to serve a copy of this order to show cause upon the parties to the appeal by regular mail.

SCHEINKMAN, P.J., MASTRO, RIVERA, DILLON and BALKIN, JJ., concur.
