DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Alex G. Colasanto, Appellant.

Motion by respondent on an appeal from a judgment of conviction of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, rendered April 15, 2019, to strike the appeal from the appeals calendar and the general calendar on the ground that the appeal has not been properly perfected. Separate motion by appellant to compel the District Court, pursuant to CPL 460.10 (3), in effect, to file an amended return on the affidavit of errors.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that appellant's motion and respondent's motion are consolidated for the purposes of disposition; and it is further,

ORDERED that respondent's motion is denied as moot; and it is further,

ORDERED that the appellant's motion is denied.
