| DECISION & ORDER ON MOTION |
Motion by the appellant to stay the sale of the subject premises, pending hearing and determination of an appeal from an amended judgment of the Supreme Court, Suffolk County, dated December 10, 2018.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the sale of the subject premises, identified by Suffolk County Tax Map District 0905, Section 004.00, Block 01.00, Lot Nos. 023.00, 026.033, and 030.001, and identified by Suffolk County Tax Map District 0905, Section 004.00, Block 01.00, Lot No. 022.001, both located on Montauk Highway, Westhampton Beach, New York, is stayed pending hearing and determination of the appeal on condition that the appeal is perfected on or before December 23, 2019; and it is further,
ORDERED that in the event the appeal is not perfected on or before December 23, 2019, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
