DECISION & ORDER ON MOTION
| The People of the State of New York, Respondent, v Donald Vanderveer, Appellant. |
On the court's own motion, it is
ORDERED that the above-entitled appeal from a judgment of conviction of the Justice Court of the Town of East Hampton, Suffolk County, rendered November 30, 2015, is stricken from the appeals calendar and the general calendar, as the appeal has not been properly perfected.
For the appeal to be properly perfected, the record must include a transcript of the Justice Court's charge to the jury which took place on October 23, 2015. If the charge was not transcribed, appellant may move in the Justice Court to reconstruct the missing portion of the record.
