Motion by the respondent, in effect, to abate a proceeding pursuant to CPLR article 78, which was transferred to this Court by order of the Supreme Court, Dutchess County, dated January 28, 2019, upon the death of the petitioner on August 10, 2019.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the proceeding is dismissed.
