Appeal by Tiana S. and Matthew S. from an order of the Family Court, Dutchess County, dated July 29, 2019. By order to show cause dated October 29, 2019, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal insofar as taken by Tiana S. in the above-entitled proceedings for failure to comply with a scheduling order dated September 12, 2019, issued pursuant to § 670.3(b)(2) of the rules of this Court (22 NYCRR 670.3[b][2]). By separate order to show cause also dated October 29, 2019, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal insofar as taken by Matthew S. for failure to comply with the scheduling order dated September 12, 2019.
Now, upon the orders to show cause and the papers filed in response thereto, it is
ORDERED that the motions are granted, and the appeal is dismissed, without costs or disbursements, for failure to comply with the scheduling order dated September 12, 2019, issued pursuant to § 670.3(b)(2) of the rules of this Court (22 NYCRR 670.3[b][2]).
