DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Maria Mayrose, Appellant.

Motion by appellant to compel the trial court to file a return and to enlarge the time to perfect the appeal on an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered January 10, 2019.

Upon the papers filed in support of the motion and the papers having been filed in opposition thereto, it is

ORDERED that the motion to compel and to enlarge the time to perfect the appeal is denied.

By Decision & Order on Motion dated August 29, 2019, appellant's motion to vacate dismissal was granted "on condition appellant file an affidavit of errors within 30 days from the date of this decision and order on motion." Inasmuch as it appears that no affidavit of errors was filed and no motion for an extension of time to file the affidavit of errors was made pursuant to CPL 460.30, the appeal is dismissed.
