DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Gloria Marcia, Appellant.

Motion by appellant to compel the lower court to transfer the file, and to enlarge the time to perfect on an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered April 17, 2019.

Upon the papers filed in support of the motion and the papers having been filed in opposition thereto, it is

ORDERED on the court's own motion that the appeal is dismissed; and it is further

ORDERED that the motion to compel the lower court to transfer the file, to enlarge the time to perfect the appeal and the separate motion to continue the stay are denied as moot.

Appellant failed to properly take the appeal as required by CPL 460.10 (3) (c), or move pursuant to CPL 460.30 for an extension of time to file the affidavit of errors.
