DECISION & ORDER ON MOTION

Motion by the respondent for leave to file a supplemental brief on appeals from an order of the Supreme Court, Westchester County, dated May 13, 2019, or, in the alternative, for leave to withdraw the previously filed respondent's brief and to serve and file a replacement respondent's brief. Cross motion by the appellants Iona College and Kathleen McElroy and separate motion by the appellant Anthony D. Dougherty and Tarter Krinsky & Dorgin, LLP, to extend the time to serve and file their respective reply briefs.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the papers filed in support of the cross motions and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to withdraw the previously filed respondent's brief and to serve and file a replacement respondent's brief is granted, the respondent's time to serve and file a replacement brief is extended until January 16, 2020, and the respondent's replacement brief shall be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that the cross motions are granted, and the appellants' time to serve and file their respective reply briefs is extended until February 18, 2020, and the reply briefs shall be served and filed on or before that date.
