DECISION & ORDER ON MOTION

Motion by the respondent Village of Montebello to dismiss an appeal from an order of the Supreme Court, Rockland County, entered December 21, 2018, as untimely taken, and on the ground that the right of direct appeal from the order terminated upon entry in the above-entitled proceeding of a judgment dated February 27, 2019. Separate motion by the respondent County of Rockland to dismiss the appeal as untimely taken, on the ground that the right of direct appeal from the order terminated upon entry of the judgment, and for failure to timely perfect.

Upon the papers filed in support of the motions, and the papers filed in opposition thereto, it is

ORDERED that the motions are denied as academic, as the appeal has been deemed dismissed pursuant to 22 NYCRR 1250.10(a).
