DECISION & ORDER ON MOTION

2018-25 K CR
The People of the State of New York, Respondent, v Russell Hazelton, Appellant.

Motion by appellant to withdraw the appellant's brief on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered December 1, 2017, and, in effect, to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to withdraw the appellant's brief is granted and the appellant's brief is deemed withdrawn; and it is further,

ORDERED that the branch of the motion seeking, in effect, an enlargement of time to perfect the appeal is granted and the time to perfect the appeal is enlarged to June 2, 2020; and it is further,

ORDERED that in the event the appeal is not perfected by June 2, 2020, the court, on its own motion, may dismiss the appeal, or respondent may move to dismiss the appeal, on three days' notice, and may serve such motion in person.
