DECISION & ORDER ON MOTION
| Clinton Hill Apts. Owners Corp., Respondent, v Paula N. Hill, Individually, Appellant, and Paula N. Hill, as Administratrix of the Estate of Florida Hill, and Steven Goodine, Tenants, et al., Undertenants. |
Appeal from an order of the Civil Court of the City of New York, Kings County, entered February 27, 2018.
On the court's own motion, it is
ORDERED that the appeal is dismissed.
Inasmuch as the estate of the deceased tenant of record is a necessary party to the proceeding and to the appeal, and inasmuch as appellant was removed as administratrix of the estate in 2012 and did not serve the motion papers giving rise to the order appealed from and the notice of appeal upon the successor administrator, the appeal must be dismissed (see Manko v Gabay 175 AD3d 489 [2018]).
