DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Patrick McCaul, Appellant.

Motion by appellant on an appeal from judgments of conviction of the Justice Court of the Town of Lagrange, Dutchess County, rendered July 17, 2018, for an enlargement of time to perfect the appeal and to continue a stay of the execution of those judgments which was granted by decision and order on motion of this court dated March 15, 2019 and extended by decision and order on motion of this court dated July 30, 2019.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and the stay is extended, except as to the conditions of probation, on condition that the appeal be perfected by March 6, 2020; and it is further,

ORDERED that in the event the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay, on three days' notice, and may serve such application in person.
