DECISION & ORDER ON MOTION

2019-13431

Gabor Rona, etc., respondent,

v 1 Prospect Park ALF, LLC, et al., defendants,

Copper Group, Inc., et al., appellants

(and a third-party action).

(Index No. 516190/16)

Motion by the appellants to stay the trial in the above-entitled action, pending hearing and determination of appeals from two orders of the Supreme Court, Kings County, dated April 3, 2019, and November 13, 2019, respectively, to extend the time to perfect the appeal from the order dated April 3, 2019, to consolidate the appeals, and for a preference in the calendaring of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to extend the time to perfect the appeal from the order dated April 3, 2019, is granted and the appellants' time to perfect that appeal is extended until February 13, 2020; and it is further,

ORDERED that the branch of the motion which is to consolidate the appeals is denied as unnecessary as the appeals may be consolidated as of right (see 22 NYCRR 1250.9[f][3]); and it is further,

ORDERED that the motion is otherwise denied.

BALKIN, J.P., CHAMBERS, COHEN and CONNOLLY, JJ., concur.
