It is Ordered that the motion by respondent-appellant for a stay of enforcement of the final judgment and warrant of eviction is granted on the condition that respondent-appellant: (1) perfects its appeal by no later than the May 2020 Term, the filing deadline for which is March 10, 2020; (2) posts an undertaking on or before January 10, 2020, in the amount of $12,898, representing use and occupancy arrears through December 2019, and (3) pays monthly use and occupancy to petitioner in the amount provided in the licence agreement, on or before each due date, without prejudice. In the event of respondent-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move, on five days notice, for an order vacating the stay.
