An appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about July 31, 2019, And defendant-appellant having moved for (1) a stay of enforcement of the order pending hearing and determination of the appeal taken therefrom; (2) an injunction to prohibit the hearing before the Special Referee; (3) leave to appeal from the aforesaid order entered on or about July 31, 2019 to the extent it is not appealable as of right; (4) a preference in hearing of the appeal, and (5) an enlargement of the record on appeal to include the order of the same court entered on or about November 19, 2018, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion, to the extent it seeks leave to appeal, is denied as unnecessary.
