v FHS Consultants, LLC, respondent.

(Index No. 513969/16)

DECISION & ORDER ON MOTION

Motion by the appellant for leave to appeal to this Court from an order of the Supreme Court, Kings County, dated October 2, 2019, and to stay enforcement of the order pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal from so much of the order as granted the respondent's cross motion to the extent of limiting and precluding it from serving further document demands and interrogatories is denied as unnecessary as that portion of the order is appealable as of right (see CPLR 5701); and it is further,

ORDERED that the branch of the motion which is for leave to appeal from the remainder of the order is granted; and it is further,

ORDERED that the motion is otherwise denied.

DILLON, J.P., HINDS-RADIX, MALTESE and IANNACCI, JJ., concur.
