(File No. 3311/10)

DECISION & ORDER ON MOTION

Motion by the appellants to extend the time to perfect an appeal from an order of the Surrogate's Court, Suffolk County, dated January 4, 2019.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the appeal is dismissed on the ground that no appeal lies as of right from an order that does not decide a motion made on notice (see CPLR 5701), and leave to appeal has not been granted; and it is further,

ORDERED that the appellants' motion is denied as academic.

CHAMBERS, J.P., AUSTIN, MILLER and DUFFY, JJ., concur.
