JPMorgan Chase Bank, National Association,
respondent, v Gary Newton, etc., et al., appellants.
(Index No. 7120/17)
Appeals from five orders of the Supreme Court, Orange County, three dated May 1, 2018, February 28, 2019, and July 15, 2019, respectively, and two dated November 26, 2019, and an order and judgment (one paper) of the same court also dated November 26, 2019. Motion by the appellants to stay enforcement of the order and judgment pending hearing and determination of the appeal therefrom, and to stay the foreclosure sale of the subject premises.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, the parties to the appeals are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeals from the orders on the ground that the right of direct appeal from the orders terminated upon entry in the above-entitled action of the order and judgment (see Matter of Aho, 39 NY2d 241), by filing an affirmation or an affidavit on that issue in the office of the Clerk of this Court on or before February 20, 2020, or, if the appellants be so advised, by making a motion, on or before February 20, 2020, for any relief deemed appropriate; and it is further,
ORDERED that service of this order to show cause will be effected when the order to show cause is uploaded to the New York State Court Electronic Filing System by the Clerk of the Court or her designee.
