Appeal from an order of the Supreme Court, Nassau County, dated August 2, 2019.
On the Court's own motion, it is
ORDERED that the parties are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the appeal has been rendered academic, as the respondent has been retried and acquitted of the charges against him, by filing an affirmation or an affidavit on that issue in the office of the Clerk of this Court on or before February 20, 2020; and it is further,
ORDERED that the Clerk of this Court or her designee is directed to serve a copy of this order to show cause upon the respondent's assigned counsel and upon the District Attorney, either personally or by ordinary mail pursuant to CPL 470.60(2).
