ORDERED that this appeal, improperly taken to the Appellate Term for the Second, Eleventh and Thirteenth Judicial Districts, is transferred to the Appellate Term for the Ninth and Tenth Judicial Districts (see NY Const., art VI, § 5 [b]); and it is further,

ORDERED that all further proceedings in connection with the appeal shall be conducted pursuant to the rules of the Appellate Term for the Ninth and Tenth Judicial Districts.
