On the Court's own motion, it is
ORDERED that the decision and order on motion dated February 3, 2020, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by the appellant to restrain the respondent from taking any action to change the parenting schedule in the above-entitled action pending hearing and determination of an appeal from a decision of the Supreme Court, Nassau County, entered October 31, 2019.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the appeal from is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co., 100 AD2d 509); and it is further,
ORDERED that the motion is denied as academic.
