ORDER TO SHOW CAUSE

Appeal from an order of the Supreme Court, Nassau County, entered January 2, 2019. By decision and order on motion of this Court dated December 20, 2019, the appellant was directed to, on or before January 21, 2020, serve and file a replacement appellant's record that complied with the rules of this Court and did not contain matter dehors the record, and a replacement brief that cited to the replacement record. The appellant failed to serve and file a replacement appellant's record and a replacement brief.

Now, on the Court's own motion, it is

ORDERED that the parties to the appeal are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled action for failure to comply with the decision and order on motion of this Court dated December 20, 2019, by each filing an affirmation or affidavit on that issue in the office of the Clerk of this Court and serving one copy of the same on each other on or before February 26, 2020; and it is further,

ORDERED that the Clerk of this Court, or her designee, is directed to serve a copy of this order to show cause upon the parties by regular mail.
