| DECISION & ORDER ON MOTION |
Motion by the respondent on appeals from a judgment of the Supreme Court, Suffolk County, dated May 2, 2018, and an order of the same court, also dated May 2, 2018, to vacate a stay of enforcement of the judgment, which was granted by decision and order on motion of this Court dated September 20, 2018, pending hearing and determination of the appeals, on condition that the appeals were perfected by October 22, 2018.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied as unnecessary, as the appeals have been deemed dismissed (see 22 NYCRR 1250.10[a]).
