An application having been made by defendant pursuant to CPL 245.70(6) for expedited review of a ruling of a Justice of the Supreme Court, New York County (Ann E. Scherzer, J.), as set forth in an order of that court, dated January 31, 2020, which granted the People's motion for a protective order, and upon such review, to vacate or modify the ruling,

Now, upon review of the papers filed with respect to the application, it is

Ordered that the application is denied in its entirety, the motion court having providently exercised its discretion in delaying production of the materials, and it is further

Ordered that the papers submitted in connection with the application which were sealed by the motion court, and/or which disclose matters which were sealed, shall continue to be sealed. The un-redacted affirmation and memorandum of law submitted by the People shall be sealed by the Clerk of the Court.
