| ECISION & ORDER ON APPLICATION |
Application by Melissa Paladino, as administrator of the estate of Joan A. Klocke, to be substituted for the deceased appellant Brigitte Wallace, former administrator of the estate of Joan A. Klocke, in a proceeding pursuant to CPLR article 78, which was transferred to this Court by order of the Supreme Court, Suffolk County, dated August 16, 2018, to amend the caption accordingly, and for leave to withdraw the proceeding.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, Melissa Paladino, as administrator of the estate of Joan A. Klocke, is substituted for the deceased appellant Brigitte Wallace, former administrator of the estate of Joan A. Klocke, and the caption is amended accordingly; and it is further,
ORDERED that the proceeding is deemed withdrawn, without costs or disbursements.
