Motion by the respondent to dismiss an appeal from an order of the Family Court, Suffolk County, dated September 4, 2018, based upon the fugitive disentitlement doctrine. By decision and order on motion of this Court dated November 28, 2017, the motion was held in abeyance, and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof. The appeal was dismissed by decision and order on motion of this Court dated January 28, 2020.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as academic.
