The People, etc., respondent,

v Richard C. Bruno, Jr., appellant.

(Ind. No. 2639A/15)

DECISION & ORDER ON MOTION

Appeal by Richard C. Bruno, Jr. from a judgment of the County Court, Suffolk County, rendered December 20, 2016. By order to show cause dated December 30, 2019, the appellant was directed to show cause before this Court why the appeal should or should not be dismissed on the ground that the notice of appeal from the judgment was untimely.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed (see CPL 460.30).

DILLON, J.P., BALKIN, AUSTIN and DUFFY, JJ., concur.
