The People, etc., respondent,

v Jason Brewster, appellant.

(Ind. No. 80/17; S.C.I. No. 229/17)

DECISION & ORDER ON MOTION

Motion by the respondent, inter alia, for leave to serve and file a supplemental record on appeals from two judgments of the County Court, Dutchess County, both rendered September 6, 2017, or, in the alternative, to enlarge the judgment roll to include a certain felony complaint.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to serve and file a supplemental record is denied; and it is further,

ORDERED that the branch of the motion which is to enlarge the judgment roll to include the felony complaint is denied as unnecessary as the felony complaint is properly part of the record and has been filed as an exhibit in the office of the Clerk of the Court; and it is further,

ORDERED that the motion is otherwise denied.

DILLON, J.P., BALKIN, CHAMBERS and COHEN, JJ., concur.
