DECISION & ORDER ON MOTION

Appeal by Marc Fishman from an order of the Supreme Court, Westchester County (IDV Part), dated May 31, 2019. By scheduling order dated February 7, 2020, the appellant's time to perfect the appeal was extended until March 6, 2020. The appellant has failed to perfect the appeal.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.3[b][2]) and prior order of the Court.
