2019-01163 The People, etc., respondent, v Napoleon C. Curtis, appellant. (Ind. No. 2317/17)
| DECISION & ORDER ON MOTION |
Motion by the respondent to enlarge the judgment roll on an appeal from a judgment of the County Court, Suffolk County, rendered January 9, 2019, to include the transcript of a hearing which occurred on December 21, 2018, and to extend the time to serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to enlarge the judgment roll to include a certain transcript is denied as unnecessary as the transcript of the hearing which occurred on December 21, 2018, is properly part of the record; and it is further,
ORDERED that on or before June 17, 2020, the respondent shall cause the transcript of the hearing which occurred on December 21, 2018, to be filed with the Clerk of the Court; and it is further,
ORDERED that the branch of the motion which is to extend the time to serve and file a brief is denied as unnecessary, as the respondent's brief was timely served and filed.
