| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, to be provided with the transcripts of the proceedings on appeals from an order of the Family Court, Orange County, dated November 27, 2018, and an amended order of the same court dated January 7, 2019, and to extend the time to perfect the appeals.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings, if any, except for those minutes previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the clerk of the Family Court, and the clerk of the Family Court shall furnish one of such certified transcripts to the appellant's assigned counsel, Kiel Van Horn, P.O. Box 814, Port Jervis, NY 12771, 845-858-0990, without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Family Court and one transcript shall be delivered to the assigned counsel. Assigned counsel is directed to provide copies of said transcripts to all of the other parties to the appeals, including the attorney for the children, if any, when counsel serves the appellant's brief upon those parties; and it is further,
ORDERED that the branch of the appellant's motion which is to extend the time to perfect the appeals is granted, and on or before July 20, 2020, the appellant shall cause the original papers constituting the record on the appeals to be filed in the office of the Clerk of this Court (see 22 NYCRR 1250.9[a][5]) and serve and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website, and file an original and five hard copies of the brief in accordance with any applicable administrative order or other order to be issued by the Court; and it is further,
ORDERED that assigned counsel is directed to serve a copy of this decision and order on motion upon the clerk of the court from which the appeals are taken.
