(Index No. 1581/14)

DECISION & ORDER ON MOTION

Motion by the appellant, on an appeal from an order of the Supreme Court, Orange County, dated October 30, 2019, to stay enforcement of a judgment entered in the action and to set aside any sale of the subject premises, pending hearing and determination of the appeal from the order, and for poor person relief and the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion which are to stay enforcement of the judgment in the action and to set aside any sale of the subject premises are denied; and it is further,

ORDERED that the branch of the motion which is for leave to prosecute the appeal on the original papers is denied as unnecessary, as leave to prosecute the appeal on the original papers was granted by decision and order on motion of this Court dated February 21, 2020; and it is further,

ORDERED that the motion is otherwise denied.
